Terms of Service
Welcome to Openhood, a voice-driven digital assistant for automotive workshops ("Service"). These Terms of Service ("Terms") govern your use of Openhood, which is owned and operated by BetterLabs Pty Ltd (BetterLabs), a venture studio backed by the Royal Automobile Club of Western Australia ("BetterLabs", "we", "us", or "our").
By accessing or using Openhood, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. Definitions
In these Terms:
- "Service" means the Openhood platform, including the voice-driven assistant software, digital inspection reporting tools, service advisor triage features, and all related services and functionalities.
- "User" means any individual or entity that accesses or uses the Service, including automotive mechanics, service advisors, workshop managers, and authorised personnel.
- "Workshop" means the automotive service business that has registered for and uses the Service.
- "Customer Data" means all data and information relating to vehicles, vehicle owners, inspection reports, service records, and recommendations created or processed through the Service.
- "Voice Data" means audio recordings and transcriptions captured through the voice-driven features of the Service.
2. Service Description
Openhood provides a digital platform designed to:
- Replace paper-based job cards and inspection reports with digital alternatives;
- Enable voice-driven data entry and report completion;
- Facilitate real-time triage of additional work opportunities;
- Streamline workshop operations and reduce manual data entry;
- Enhance transparency and communication between workshops and their customers.
- As a pre-product software project, the Service may be subject to modifications, updates, and improvements without prior notice.
3. Account Registration and Security
To use Openhood, your Workshop must register for an account. You agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and promptly update your account information;
- Keep your login credentials secure and confidential;
- Immediately notify us of any unauthorized access or security breach;
- Accept responsibility for all activities that occur under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates applicable laws or regulations;
- Input false, misleading, or fraudulent information into inspection reports or service records;
- Attempt to gain unauthorized access to the Service or its related systems;
- Use the Service to transmit viruses, malware, or other harmful code;
- Interfere with or disrupt the Service or servers or networks connected to the Service;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Use the Service for any purpose other than legitimate automotive service operations.
5. Voice Recognition and Data Processing
By using the voice-driven features of Openhood, you acknowledge and agree that:
- Voice commands and dictations will be processed and may be temporarily stored for transcription purposes;
- Voice recognition technology may not be 100% accurate and you are responsible for reviewing and verifying all transcribed content;
- Background noise and audio quality may affect transcription accuracy;
- You will ensure appropriate consent is obtained from any individuals whose voices may be captured;
- Voice Data will be processed in accordance with our Privacy Policy.
6. Data Ownership and Use
Customer Data: Your Workshop retains ownership of all Customer Data entered into the Service. You grant BetterLabs a non-exclusive, worldwide license to use, process, and store Customer Data solely for the purpose of providing the Service.
Aggregated Data: We may collect and use aggregated, anonymized data derived from your use of the Service for analytics, research, and service improvement purposes. Such data will not identify your Workshop or any individual customer.
Feedback: Any feedback, suggestions, or improvements you provide regarding the Service may be used by BetterLabs without compensation or attribution.
7. Professional Responsibility and Disclaimers
Not a Substitute for Professional Judgment: The Service is a tool to assist automotive professionals. It does not replace professional mechanical expertise, judgment, or responsibility. Users remain solely responsible for:
No Warranty of Accuracy: While we strive for accuracy, BetterLabs makes no warranty that the Service will be error-free or that voice transcriptions, suggestions, or automated features will be accurate or appropriate for every situation. All reports generated must be reviewed by users.
- The accuracy and completeness of all inspection reports;
- All service recommendations and work performed;
- Compliance with automotive industry standards and regulations;
- Vehicle safety assessments and certifications;
- Customer communications and advice.
8. Intellectual Property Rights
You may not:
The Service, including all software, designs, text, graphics, logos, and other content, is owned by BetterLabs or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
- Copy, modify, or distribute the Service or any portion thereof;
- Create derivative works based on the Service;
- Remove or alter any proprietary notices or labels;
- Use our trademarks, logos, or branding without written permission.
9. Payment Terms
If the Service requires payment:
- Subscription fees and pricing will be as specified in your service agreement;
- Fees are payable in advance and are non-refundable except as required by law;
- We reserve the right to modify pricing with 30 days' notice;
- Failure to pay fees may result in suspension or termination of service.
- During any beta or trial period, the Service may be provided free of charge, with potential fees applying after the trial period ends.
10. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
You must ensure that all personal information collected from vehicle owners and other individuals through the Service is handled in compliance with applicable privacy laws, including obtaining necessary consents.
11. Limitation of Liability and Your Responsibilities
Use at Your Own Risk: You acknowledge and agree that you use Openhood entirely at your own risk. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
No Liability: To the maximum extent permitted by law, BetterLabs and Openhood will not be liable to you or any third party for any damages whatsoever arising from or relating to your use of or inability to use the Service, including but not limited to:
- Direct, indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, or business opportunities;
- Damage to vehicles or property;
- Personal injury or death;
- Claims by vehicle owners or third parties;
- Errors or omissions in inspection reports or service recommendations;
- Service interruptions, system failures, or data loss;
- Inaccurate voice transcriptions or automated suggestions;
- Any losses arising from your reliance on the Service.
Your Sole Responsibility: You acknowledge and agree that you are solely responsible for:
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above exclusions may not apply to you.
- Your use of the Service and all consequences thereof;
- Compliance with these Terms and all applicable laws and regulations;
- The accuracy and completeness of all information you input into the Service;
- All services, repairs, and advice provided to your customers;
- Obtaining and maintaining appropriate business insurance;
- Any disputes, claims, or liabilities arising between your Workshop and its customers or third parties;
- All costs and expenses relating to any claims or disputes arising from your use of the Service.
- No Third-Party Beneficiaries: BetterLabs has no relationship with your customers and accepts no responsibility for claims made by vehicle owners or other third parties relating to your use of the Service or work performed by your Workshop.
12. Service Modifications and Interruptions
We reserve the right to:

- Modify, suspend, or discontinue the Service at any time;
- Perform maintenance that may temporarily interrupt service;
- Update features, functionality, or user interface without notice;

13. Termination
Either party may terminate these Terms:
Upon termination:
Your access to the Service will be discontinued;
You must cease all use of the Service;
We may delete your data after a reasonable retention period;
All accrued rights and obligations shall survive termination.
- By providing 30 days' written notice to the other party;
- Immediately if the other party materially breaches these Terms;
- Immediately in case of insolvency, bankruptcy, or cessation of business.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Western Australia, Australia, without regard to conflict of law principles.
Any dispute arising from these Terms shall be:
- First attempted to be resolved through good faith negotiation;
- If negotiation fails, submitted to mediation in Perth, Western Australia;
- If mediation fails, resolved through binding arbitration under the rules of the Australian Centre for International Commercial Arbitration.
15. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetterLabs regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
Force Majeure: Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control.
16. Beta/Pre-Product Considerations
As Openhood is a pre-product software project:
- Features and functionality may change significantly;
- The Service may contain bugs or errors;
- Uptime and performance are not guaranteed;
- Feedback and usage data will be particularly valuable for development;
- Commercial terms may be revised upon full product launch.
